Cancellation and participation conditions

1. Scope of application

These General Terms and Conditions govern the contractual relationship between you as a participant in events (seminars, courses and conferences, etc.) and Working Products Schulte Strathaus GbR, Simon-von-Utrecht-Straße 85a, 20359 Hamburg (hereinafter referred to as "Working Products GbR"). Any deviating general terms and conditions of the participant are expressly rejected. They shall have no validity whatsoever.

2. Registration/registration confirmation

You can register for Working Products GbR events via the respective event website, via the Internet, by letter, by e-mail or by telephone. Your registration is legally an offer to conclude an event contract to which you are bound for 10 days.
Your offer will be accepted by Working Products GbR in writing or in text form. Should we declare acceptance only after the expiration of your binding period, our confirmation on our part shall constitute an offer to conclude a corresponding contract, which you then accept by paying the respective valid remuneration. In this respect, we waive the receipt of a corresponding declaration according to § 151 BGB.

3. Performance

Unless otherwise stated in the event announcement, the remuneration usually includes access to the event, the event documents in electronic form as well as beverages during breaks. In the case of purely remote events, access is via an access link and break drinks are of course not provided. Working Products GbR reserves the right to replace announced speakers with others and to make necessary changes to the event program while maintaining the overall character of the event.
If an event cannot be held due to force majeure, COVID 19 infection, the inability of one or more speakers to attend, disruptions at the event location, or a low number of participants, the participants will be informed immediately. Cancellation due to insufficient number of participants will not be made later than 10 days before the event. The event fee will of course be refunded in such cases. A claim for compensation of travel and accommodation costs as well as loss of work is excluded, unless such costs arise due to grossly negligent or intentional behavior on our part. Working Products GbR undertakes to do everything reasonable to help remedy or limit any disruptions in performance that may occur.

The remuneration stated in the respective event is per person and event date plus statutory value-added tax. If special benefits are granted for certain events (e.g. for students, certain professional groups, etc.), you must provide evidence of the respective requirements by submitting the relevant certificates and/or receipts. The actual receipt of your registration by us is decisive for the claiming of early bird rates.

4. Due date and payment, default, set-off

The fee payable for the respective event is due upon receipt of the confirmation of participation and invoice and is payable within 14 days of receipt of the invoice. § Section 286 (3) of the German Civil Code (BGB) shall remain unaffected. If the applicant defaults on payment, we shall be entitled to charge default interest of 5 percentage points p.a. for consumers and 9 percentage points p.a. for companies, in each case above the respective base interest rate of the ECB (§ 247 para. 1, § 288 para. 1 or para. 2 BGB). If we should have suffered a higher damage caused by delay, Working Products GbR is entitled to claim this damage upon proof. You are also entitled to prove that Working Products GbR has not suffered any damage or that the damage is significantly lower than previously claimed.
If the event announcement does not provide for a specific method of payment, you are generally entitled to pay the fee by direct debit, invoice or credit card, at your discretion. However, Working Products GbR reserves the right to exclude certain payment methods in individual cases. Payment by sending cash or checks is not possible; Working Products GbR does not assume any liability in case of loss.
A set-off with counterclaims is only possible if these have been acknowledged in writing by Working Products GbR or if they have been legally established; you can only exercise a right of retention if your right is based on the same contractual relationship.

5. Cancellation

Cancellation of your registration must be made in writing. Cancellation is only possible free of charge up to 45 days before the start of the event. Cancellation between 44 and 30 days before the event will be charged with 25%, between 29 and 14 days before the event with 50% and between 13 and 7 days before the event with 75%.
In case of cancellation 6 days or more before the event or in case of no-show at the event, the entire agreed fee will be owed. You are of course entitled to provide a substitute participant at any time. You are generally entitled to prove that Working Products GbR has not suffered any damage at all due to the cancellation of the event or that this damage is significantly lower than the cancellation fee retained by Working Products GbR.

6. Copyrights

All conference documents, images, hand-outs, etc. (whether in physical or electronic form) that you receive from Working Products GbR at events are protected by copyright. The copyright belongs to the respective author, who is named as the author in the respective document. You are only and exclusively granted a simple, non-exclusive, non-transferable right of use for personal use. You or third parties are not permitted to change the content or editorial content of the conference documents or to use modified versions, to copy them for third parties, to make them publicly accessible or to forward them, to post them on the Internet or other networks, whether for a fee or free of charge, to imitate them, to resell them or to use them for commercial purposes, not even in part. Any copyright notices, marks or trademarks may not be removed by you or any third party.

7. Consent to photo and video recordings

At all Working Products GbR events, photographs and video recordings are made, which are subsequently published on the websites of Working Products GbR and our event partners eparo GmbH and Arbeitsfrische (Beate Winter) and in social media channels, platforms such as facebook, instagram, YouTube, twitter, flickr, etc. to document the event. In addition, an image film will be created, if necessary, in which scenes of the event will be processed.
This is to be evaluated on- and offline in all media without restriction by Working Products GbR, eparo GmbH and Arbeitsfrische (Beate Winter) and used in particular for corporate advertising purposes. Group photos and individual portraits of visitors to the events may also be taken.
By entering the event premises, the visitor agrees that photographs and video recordings may be made of him/her during the visit to the event and published in the aforementioned manner.
The making of own audio and video recordings is prohibited.

8. Liability

The events are carefully prepared and conducted by qualified speakers. Nevertheless, we assume no liability for the timeliness, accuracy and completeness in relation to the conference documents made available to you and the implementation of the event.
The contracting parties shall be liable to each other without limitation in the event of injury to life, limb or health, breach of warranties as to quality, fraudulent concealment of defects, breach of material contractual obligations (so-called cardinal obligations) and, irrespective of the cause, for damage caused intentionally. The provisions of the Product Liability Act shall also remain unaffected.
In all other respects, the liability of the contracting parties shall be limited to the total remuneration agreed for the respective event.
The aforementioned limitations of liability shall also apply to organs, executive staff, employees and/or vicarious agents of the contracting parties.
Special limitation of liability for the checkroom:
Insofar as we offer the possibility, against payment or free of charge, to store items, e.g. coats, jackets, suitcases or bags, for you ("checkroom"), the following additional conditions apply:
You may not leave any valuables (e.g., laptops, smartphones, jewelry), data carriers containing confidential and/or business information, payment instruments/cards, or travel tickets at the Cloakroom.
We are liable for property damage and financial loss due to damage or loss of the items only in the case of intentional or grossly negligent acts of one of our organs and/or vicarious agents and/or assistants, in the case of injury to life, limb or health, in the case of breach of warranties as to quality, fraudulent concealment of defects and, irrespective of the reason, unlimited liability for damage caused intentionally; in all other cases liability is excluded.

9. Age restriction

The admission to events of Working Products GbR is regularly only allowed for persons 18 years and older. Adolescents over 16 years of age are admitted until midnight at the latest and only in the company of a guardian or legal guardian.
Parental guardians must carry written proof of their authorization and show a copy of the guardian's ID upon request.

10. Right of withdrawal for consumers

Participants whose registration cannot be attributed to their commercial or self-employed professional activity (consumers in the sense of § 13 BGB) have the right to cancel their registration in writing within 14 days after receipt of the registration confirmation without giving reasons. Cancellation fees will not be charged. Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reason.
The revocation period is fourteen days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform Working Products GbR, represented by the managing directors, Beate Schulte Strathaus and Dr. Rolf Schulte Strathaus, Simon-von-Utrecht-Straße 85a, 20359 Hamburg, Fax: +49 40 / 822 95 62-22, Tel.: +49 40 822 95 62-0, info@working-products.de, by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract.
To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the cancellation period.

Consequences of the revocation
If you revoke this contract, Working Products GbR must return to you all payments that we have received from you, including the delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the favorable standard delivery offered by us), without delay and at the latest within fourteen days from the day on which Working Products GbR received the notification of your revocation of this contract. For this repayment, Working Products GbR will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.
If you have requested that the services begin during the withdrawal period, you must pay Working Products GbR a reasonable amount that corresponds to the proportion of the services already provided up to the point in time at which you notify Working Products GbR of the exercise of the right of withdrawal with regard to this contract, compared to the total scope of the services provided for in the contract.
