These General Terms and Conditions govern the contractual relationship between you as a participant in events (seminars, courses and conferences, etc.) and Working Products Schulte Strathaus, Suerhoper Brunnenweg 12, 21244 Buchholz i.d.N. (hereinafter “Working Products”). Any conflicting general terms and conditions of the participant are expressly rejected. They shall have no validity whatsoever.
You may register for Working Products events via the relevant event website, via the internet, by post or fax, by email or by telephone. Your registration constitutes a legally binding offer to conclude an event contract, to which you are bound for 10 days.
Acceptance of your offer shall be effected by written confirmation from Working Products or by confirmation in text form. Should we declare our acceptance only after the expiry of your binding period, our confirmation shall constitute an offer on our part to conclude a corresponding contract, which you then accept by paying the applicable fee. In this respect, we waive the requirement for a corresponding declaration pursuant to Section 151 of the German Civil Code (BGB).
Unless otherwise stated in the event announcement, the fee generally includes access to the event, the event materials in electronic form, and refreshments during breaks. For purely remote events, access is provided via an access link and refreshments are, of course, not provided. Working Products reserves the right to replace announced speakers with others and to make necessary changes to the event programme whilst preserving the overall character of the event.
If it is not possible to hold an event due to force majeure, the COVID-19 infection situation, the unavailability of one or more speakers, disruptions at the venue, or an insufficient number of participants, participants will be informed immediately. Cancellation due to insufficient numbers of participants will take place no later than 10 days before the event. The event fee will, of course, be refunded in such cases. Any claim for reimbursement of travel and accommodation costs or loss of earnings is excluded, unless such costs arise due to gross negligence or wilful misconduct on our part. Working Products undertakes to do everything reasonable in the event of any service disruptions to help resolve or minimise the disruption.
The fee stated for the respective event is per person and event date, plus statutory VAT. Where special discounts are offered for certain events (e.g. for students, certain professional groups, etc.), you must provide evidence of meeting the relevant requirements by presenting the appropriate certificates and/or supporting documents. For the purpose of claiming early bird discounts (so-called early bird rates), the actual date of receipt of your registration by us shall be decisive.
The fee payable for the respective event is due upon receipt of the confirmation of participation and invoice and must be paid within 14 days of receipt of the invoice. Section 286(3) of the German Civil Code (BGB) remains unaffected.
If the registrant defaults on payment, we are entitled to charge default interest at a rate of 5 percentage points above the respective ECB base rate for consumers and 9 percentage points above the respective ECB base rate for businesses (§ 247(1), § 288(1) or (2) BGB) p.a. If we have suffered greater loss as a result of the delay, Working Products is entitled to claim this upon providing evidence. You are also entitled to prove that Working Products has not suffered any loss or that the loss is significantly lower than previously claimed.
Unless a specific payment method is specified in the event announcement, you are generally entitled to pay the fee by direct debit, invoice or credit card, at your discretion. However, Working Products reserves the right to exclude certain payment methods in individual cases. Payment by sending cash or cheques is not possible; Working Products accepts no liability whatsoever in the event of loss.
Set-off against counterclaims is only possible if these have been acknowledged in writing by Working Products or have been legally established; you may only exercise a right of retention insofar as your right arises from the same contractual relationship.
Cancellation of your registration must be made in writing. Cancellation is only possible free of charge up to 45 days before the start of the event. In the event of cancellation between 44 and 30 days before the event, 25% of the respective fee is payable; between 29 and 14 days before the event, 50% is payable; and between 13 and 7 days before the start of the event, 75% of the respective fee is payable.
In the event of cancellation from 6 days before the start of the event or in the event of a no-show, the full agreed fee is payable. You are, of course, entitled to provide a replacement participant at any time. You are generally entitled to provide evidence that Working Products has not suffered any loss whatsoever as a result of the cancellation of the event, or that such loss is significantly lower than the cancellation fee retained by Working Products.
All conference documents, images, handouts, etc. (whether in physical or electronic form) that you receive at events organised by Working Products are protected by copyright. The copyright belongs to the respective author, who is named as such in the relevant document. You are granted solely and exclusively a simple, non-exclusive, non-transferable right of use for personal purposes. Neither you nor any third party is permitted to alter the content or editing of the conference documents or to use modified versions, to copy them for third parties, to make them publicly available or to forward them, to post them on the internet or other networks, whether for a fee or free of charge, to imitate them, to resell them or to use them for commercial purposes, not even in part. You or third parties must not remove any copyright notices, symbols or trademarks.
Photographs and video recordings are taken at all Working Products events, which are subsequently published on the websites of Working Products and our event partners eparo GmbH and Arbeitsfrische (Beate Winter), as well as on social media channels and platforms such as Facebook, Instagram, YouTube, Twitter, Flickr, etc., for the purpose of documenting the event. In addition, a promotional film may be produced featuring scenes from the event.
This is to be used by Working Products and Arbeitsfrische (Beate Winter) without restriction, both online and offline across all media, and in particular for corporate advertising purposes. In this context, group photos and individual portraits of event visitors may also be taken.
By entering the event venue, the visitor agrees that photographs and video recordings of them may be taken during their visit to the event and published in the manner described above.
The taking of your own audio and video recordings is prohibited.
The events are carefully prepared and conducted by qualified speakers. Nevertheless, we accept no liability for the timeliness, accuracy and completeness of the conference documents made available to you or the conduct of the event.
The contracting parties shall be liable to each other without limitation in the event of injury to life, limb or health, breach of quality guarantees, fraudulent concealment of defects, breach of essential contractual obligations (so-called cardinal obligations) and for damage caused intentionally, regardless of the reason. The provisions of the Product Liability Act shall also remain unaffected.
In all other respects, the contracting parties’ liability is limited to the total remuneration agreed for the respective event.
The above limitations of liability also apply to the organs, senior staff, employees and/or vicarious agents of the contracting parties.
Special limitation of liability for the cloakroom:
Where we offer the option, whether for a fee or free of charge, to store items for you, e.g. coats, jackets, suitcases or bags (‘cloakroom’), the following additional conditions apply:
You must not leave any valuables (e.g. laptops, smartphones, jewellery), data storage devices containing confidential and/or business information, means of payment/cards or travel tickets at the cloakroom.
We shall be liable for property damage and financial loss resulting from damage to or loss of items only in the event of wilful misconduct or gross negligence on the part of one of our officers and/or agents and/or vicarious agents, in the event of injury to life, limb or health, in the event of a breach of quality guarantees, in the event of fraudulent concealment of defects, and without limitation in the event of damage caused intentionally, regardless of the cause; otherwise, liability is excluded
Admission to Working Products events is generally restricted to persons aged 18 and over. Young people aged 16 and over may attend until midnight at the latest and only if accompanied by a legal guardian or parent.
Legal guardians must carry written proof of their authority and, upon request, present a copy of the legal guardian’s identity document.
Participants whose registration cannot be attributed to either their commercial or self-employed professional activities (consumers within the meaning of Section 13 of the German Civil Code (BGB)) have the right to withdraw their registration in writing within 14 days of receiving the confirmation of registration, without giving any reason. No cancellation fees will be charged. To meet the deadline, it is sufficient to send the notice of withdrawal in good time to the following address: Working Products Schulte Strathaus, Suerhoper Brunnenweg 12, 21244 Buchholz i.d.N., email: info@working-products.de; This right of withdrawal expires prematurely if the booked event has taken place and the participant has attended it. The following cancellation policy applies:
Right of cancellation
You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform Working Products Schulte Strathaus, represented by Dr Rolf Schulte Strathaus, Suerhoper Brunnenweg 12, 21244 Buchholz i.d.N., Tel.: +49 1621024384, info@working-products.de, by means of a clear statement (e.g. a letter sent by post or an email) regarding your decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this contract, Working Products shall reimburse you for all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and in any event within fourteen days of the day on which Working Products receives notification of your withdrawal from this contract. Working Products will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.
If you have requested that the services commence during the withdrawal period, you must pay Working Products a reasonable amount corresponding to the proportion of the services already provided up to the time you notify Working Products of your exercise of the right of withdrawal in respect of this contract, compared to the total scope of the services provided for in the contract.
